Regulators Troubled About Crib Safety

More than 4.5 million cribs have been recalled because of safety problems since 2007, according to a column published in the Atlanta Journal Constitution. However, experts say that many children may still be in danger because many parents may not be aware they have products affected by the recalls. At least 13 children have died in cribs manufactured by Simplicity Inc., the newspaper reports.  Alison Young, Atlanta Journal-Constitution  07/12/2009

Op-Ed: Evidence-Based Approach Needed in Health Care Debate

Limiting physician liability for medical malpractice will not help reduce health care costs, Tom Baker writes in an op-ed for the New York Times. According to Baker, research shows that there is too much medical malpractice, not too many medical malpractice lawsuits. In response, Baker calls for an evidence-based approach to reform the health care system and prevent medical injuries.  Tom Baker, The New York Times 07/11/2009

Fall Hazards Prompt Kolcraft Play Yard Recall

The Consumer Product Safety Commission has recalled about 1 million Kolcraft play yards imported to the United States since January 2000. In a statement, the agency said the play yards, manufactured for Carter's, Sesame Street, Jeep, Contures, Care Bear and Eric Carle, could pose a fall hazard to children. The play yards were manufactured in China, Spain and Italy and imported by Kolcraft Enterprises of Chicago.  UPI, United Press International 07/08/2009

Levaquin Cases Certified as N.J. Class

Class certification has been approved in Atlantic County, New Jersey, for cases involving Levaquin, an antibiotic manufactured by Johnson & Johnson for bacterial infections. The plaintiffs allege that Levaquin caused tendon ruptures and tendonitis, and patients who had a transplant or were over age 60 were most commonly affected. The FDA released a warning on these reported issues in July 2008.  Charles Toutant, Law.com  07/06/2009

Warning Issued for Two Smoking-Cessation Drugs

The Food and Drug Administration has issued a warning on two smoking-cessation drugs after receiving reports of suicides and suicide attempts by those under treatment. Pfizer, the maker of Chantix, and GlaxoSmithKline, the maker of Zyban, will add a black-box warning to the packaging information. The manufacturers will also now be required to disclose the suicide risk when advertising the products.  Gardiner Harris and Duff Wilson, The New York Times  07/01/2009

Difficult to Pursue Product Liability Claims against Chinese Companies

Some Chinese-made products can be hazardous or cause death; however, those affected have little recourse. Despite being named in 69 percent of all U.S. recalls, Chinese companies are extremely difficult to sue since litigation can typically only be pursued in Chinese courts. U.S. lawmakers hope to make Chinese companies liable for faulty products through soon-to-be proposed legislation which will outline potential litigation requirements for foreign companies to sell products within the U.S.  Frank Greve and Grace Chung, Miami Herald  06/30/2009
